KUALA LUMPUR, Aug 5 — A company that owns the famous ‘Tiga Budak Gemok’ restaurant filed a lawsuit against an individual and two companies for copyright infringement and false trademark registration.
The plaintiff, Tiga Budak Gemok Sdn Bhd filed the suit through Adnan Sharida & Associates on July 26 at the High Court here, naming Mohd Anil Ali Mohamad, his company, Maam Baraka Venture Sdn Bhd and Day Food Industry Sdn Bhd as first to third defendants.
The company, which owns 13 branches, is managed by three directors, siblings Natasha Helwa Ramlee, Muhammad Rafeel and Natalia.
In its statement of claim, the plaintiff claimed the first defendant (Mohd Anil), Natasha’s ex-husband, opened the third Tiga Budak Gemok branch at Bangi Square, Bandar Baru Bangi, but the branch was closed and he (Mohd Anil) opened a business under the brand ‘3BG’ or ‘3BG Ayam Kicap Sambal Power’.
The plaintiff also claimed that the third defendant (Day Food Industry) was involved with the first and second defendant (Maam Baraka Venture) in the 3BG business when ‘3BG Distribution Centre’ promoted the business and sought franchisees on Facebook and Instagram.
The plaintiff claims that initially, the defendants used the same logo with the plaintiff’s logo in the business, and until now, several 3BG branches still using the plaintiff’s logo to conduct their business.
The company claimed all three defendants had infringed its copyright as the plaintiff did not allow the defendants to use the plaintiff’s copyright, be it the business name ‘Tiga Budak Gemok’, its logo or the slogan ‘Ayam Kicap Sambal Power’.
According to the plaintiff, the defendants’ actions have confused the public and was wrong, illegal and unjust, as well as were malicious and fraudulent, which has caused losses and damages to the plaintiff.
As such, the plaintiff is seeking a declaration among others, that the defendants have conducted commercial infringement that violated the law by conducting a business similar to the business and trademarks of ‘Tiga Budak Gemok’ and ‘Tiga Budak Gemok Ayam Kicap Sambal Power’ owned by the plaintiff, in addition to demanding general and exemplary damages, interest and other relief deemed fit by the court.
Meanwhile, during a media conference via Google Meet, lawyer Datuk Adnan Seman, who is representing the plaintiff, said they were in the process of serving the lawsuit to all three defendants.
“The case management would be heard via online before High Court senior assistant registrar Qasiratul Jannah Usmani Othman on Aug 26,” he said.
