Mechanic Jailed, Fined For Possessing Child Pornographic Materials

KUANTAN, Sept 18  — A part-time mechanic was sentenced to six years’ jail and RM10,000 fine, in default 12 months’ jail,  by the Sessions Court here after he pleaded guilty to possessing and keeping obscene materials including child pornographic videos, last week.

Judge Siti Aminah Ghazali also ordered Lim Ming Soon, 40, to undergo counseling and to be placed under police observation for three years.

Lim was charged with possessing the obscene images and videos, which were kept in three pen drives, a hard disk, a mobile phone, and a laptop belonging to him, at 1.30 pm last Friday at his house at Jalan Haji Ahmad here.

The charge was framed under Section 292(a) of the Penal Code which carries a maximum three-year jail term or a fine or both if found guilty.

For the offense of possessing images and videos of child pornography, Lim was charged under Section 10 of the Sexual Offences Against Children Act 2017, which provides a maximum five years’ jail term or a fine of not more than RM10,000 or both, if convicted.

In mitigation, Lim’s lawyer, Rahiza Zulkifli from the National Legal Aid Foundation, said her client did not have a fixed income and was taking care of his sick parents.

Deputy public prosecutor Nasrul Hadi Abdul Ghani prosecuted.
